In accordance with applicable privacy and data protection principles common to Canada, the United States of America and other jurisdictions to which we are subject, we have developed this privacy policy (the "Policy") to explain our practices in processing your personal information. This Policy does not apply to the personal information of our employees, nor to anonymous information.
This Policy describes our practices regarding the collection, use, disclosure, retention, and destruction and processing (collectively, "Processing") of your personal information, as well as the correction, updating and access to the personal information you provide to us as a user of (a) the website operated at www.sigigods.gg, and other sites from time to time (the "Website"), (b) the video game entitled "DigiGods" and any related applications, programs, or other software (the "Game"), and (c) our related content, products and services provided through the Website and the Game (collectively with the Website and the Game but excluding any third-party software that may interact with them, the "Service"). This Policy references the general Terms of Services for Squido available at www.digigods.gg/terms, of which this Policy forms an integral part. All capitalized terms not defined herein shall have the meaning given to them in our general Terms of Services.
Our Service may contain links to third-party websites, applications, programs, software, or Internet resources ("Third-Party Services") which are provided solely for your convenience and information. When you click on one of these links, you are contacting these "Third-Party Services". PLEASE READ THIS PRIVACY POLICY CAREFULLY. By using our Service or otherwise choosing to provide us with your personal information, you acknowledge and consent to the processing of your personal information by us and our third-party service providers in accordance with this Policy and as may be further identified when the personal information is collected. We are based in Canada, but we use third-party service providers located outside of Canada to provide our Service to you. Therefore, when you use our Service, you are transferring your personal information to jurisdictions inside, and outside Canada and you expressly consent to this transfer. We will use this consent as the legal basis for such data transfer, unless otherwise stated in this Policy.
If you do not consent to the processing of your personal information in accordance with this Policy, do not access or continue to use any aspect of the Service or otherwise provide us with any personal information.
For the purposes of this Policy, "personal information" means any information about an identifiable individual or any information that can be used, alone or in combination with other information, to identify an individual (for example, an individual's name, home address, telephone number and email address), but excludes any information that is exempted by applicable privacy laws.
The types of information we receive and collect depend on how our Service is used. We require certain information to provide our Service, without which we will not be able to provide the Service. For example, a user must provide Meta account information in order to use the Game. Please note that no personal information (such as cookies) is collected when you simply use the Website.
Our Service includes optional features which, if used, require us to collect additional information to provide such features. You will be notified of such collection and your consent will be sought when appropriate. If you choose not to provide the information needed to use a feature, you will be unable to use that feature.
When you use our Service, we may collect the following personal information from you:
Additionally, your personal information may be collected in the following instances:
We only collect the personal information that we need. We encourage you not to provide us with any personal information beyond what is necessary or requested by us.
We, and our third-party partners, also automatically collect information about you and any computer or device you use to access the Service, read our emails or otherwise communicate with us. Some of the information we collect, and the means by which we collect it, include :
Usage Data. We collect information about the way you use our Service, for example, how you play our games, your save game data, how you interact with our Service and other users of our Service, the links you click on, how frequently you access the Service, whether you open emails or click the links contained in emails, whether you access the Service from multiple devices, the time you last logged in, and other actions you take on the Service. We may collect analytical data or use third-party analytics tools to help us measure traffic and usage trends on the Service and to better understand the demographics of our users. We may also work with third-party partners to employ technologies, including the application of statistical modeling tools, that attempt to recognize you across multiple devices. You can consult the "Third-party operators" section to find out about the third-party partners we work with.
We do not knowingly collect personal information from third parties, unless you consent or we are otherwise exempt, required or permitted by applicable law to do so. For example, we may collect your personal information from the following third parties:
If we collect your personal information from a third party, we will only process that information for the specific purposes for which it was provided to us, including providing you with the Service, in accordance with this Policy and the policy under which that information was collected.
To download and access the Game, you must create a Meta account. To create a Meta account, you will be asked to authorize the collection, use and disclosure of your personal information as set out in Meta's privacy statement, otherwise you will not be able to access the Game. This process is carried out directly with Meta, using the following link:
This personal information is subject to Meta's privacy policy, which we may refer you to if you have any questions. As part of this process, we do not collect, nor does Meta communicate with us, any of your personal information. Once your account has been created, you will be able to download our Game from the Meta platform. Meta will then provide us with your Meta user ID and your Meta display name so that you can be briefly identified in the Game.
To the extent that our Service contains links to other sites, the owners of those sites are responsible for the privacy practices or content of those other sites. We do not endorse and will not be responsible for the privacy practices on third-party websites or applications.
Our Service is intended for all users aged 10 and over. By accessing our Service, we may collect personal information from you in accordance with this Policy. This section is intended to notify the parents of any Children of our practices with respect to the collection of personal information from Children, and the use and disclosure thereof. This section applies only to Children and is supplementary to the other provisions of this Policy.
To access the Game, any user, including your Child, must log in via a Meta account. When registering for a Meta account, users are asked to disclose the age category to which they belong. Thus, when any user attempts to access the Game, we receive this information from a connection to the Meta program interface, which then allows us to identify whether the user is a Child. This practice is intended to ensure that we comply with all applicable laws, including the Children's Online Privacy Protection Act of 1998 and its regulations (collectively "COPPA"), in force in the United States of America. Please note that a Child will be able to access all features of the Game, just like any other user. You can modulate access to voice chat functionalities in your Meta parental account.
Creating a Meta account
A parent or legal guardian may grant access to our Service to a Child, by creating a Meta account for his or her benefit, when you download the Game. To create a Meta account for their Child, parents or legal guardians must agree to the collection, use and disclosure of their Child's information as set forth in Meta's Privacy Statement and Meta's Parent Privacy Statement. Otherwise, the Child will not be able to play the Game. This process is carried out directly with Meta, using the following link:
As a parent or legal guardian of a Child, it is important to note that you will be asked to verify your identity during the process of creating your Meta account and to provide personal information. This personal information is subject to Meta's privacy policy, which we refer you to if you have any questions. As part of this process, we do not collect, and Meta does not communicate with us, any of your personal information.
The only personal information we collect from your Child is the following:
This information is used to provide the Service and grant access to the Game and its features to your Child, once your authorization has been granted via the Meta parental account under your control. We do not share or disclose any of your Child's personal information except as follows:
It is important to note that we may share some of your Child's personal information with third-party operators who provide integrated services to our Service. These integrated services are essential to enable us to offer you a quality Service that meets your expectations. Below is a list of the various third-party operators we use, and the personal information we share with them. For more information, please refer to the section entitled "Third-party operators to whom we share personal information".
If you have any questions about the privacy policies and collection and use practices of our third-party operators, please contact us by mail at 9391-0248 Québec Inc. d.b.a. Squido Studio, 4533 rue Drolet, suite 7, Montreal (Quebec) H2T2G1, Canada, or by e-mail at info@squidostudio.com.
At any time, parents or legal guardians may review their Child's personal information that we store, request that we correct or delete such personal information, or indicate their refusal to our continued collection or use of their Child's personal information by contacting us at the e-mail address indicated above. To protect the privacy and security of parents and the privacy and security of Children using the Service, we may ask parents or legal guardians to take certain measures or provide additional information, which we will keep strictly confidential, to verify a parent's identity before providing information or making any corrections. This identity verification process must be performed through your Meta account and, as a result, personal information may be collected and exchanged with Meta for this purpose.
We may process your personal information for the following purposes (the "Purposes"):
To this end, some of your personal information may be processed automatically to present and promote products that may be of interest to you, based on your user profile. For more information on the type of automated decisions made by Squido, please contact the privacy officer (see section "Contact details of the privacy officer").
We will only process your personal information for the purposes for which we intend to process it. We will not process your personal information without your consent, except where permitted by law. You may object to the processing of your personal information at any time, and withdraw your consent to such processing, by following the procedure set out in the "Consent" section below.
We may disclose your personal information for the Purposes described in this Policy as follows:
The personal information we collect may be processed outside your jurisdiction, but only for the Purposes and in accordance with applicable laws. Consequently, your personal information may be accessible to law enforcement and regulatory authorities in accordance with applicable laws in other jurisdictions.
We will only process your personal information with your knowledge and consent, except where required, permitted or exempted by applicable law. The form of consent may vary depending on the circumstances and the type of information requested. Your consent may be explicit, with clear options to say "yes" or "no", such as being asked to check a box to indicate your consent, or implicit, such as when you provide us with your e-mail address via an information request form or e-mail and we use these means to respond to your request. Consent may also be given by your parent or legal guardian, if you are a Child. Taking into account the sensitivity of your personal information, the purposes of collection and your reasonable expectations, we will obtain the appropriate form of consent for the personal information being processed. By using our Service or otherwise by choosing to provide us with your personal information, you acknowledge and consent to the processing of your personal information in accordance with this Policy and as may be further specified at the time of collection of the personal information. When we process your personal information for a new purpose, we will document the new purpose and ask for your consent again.
If you do not consent to the processing of your personal information in accordance with this Policy, please do not access or continue to use any aspect of the Service or provide any personal information to us.
You may withhold your consent or notify us at any time that you wish to withdraw, limit or change your consent to the processing of your personal information without penalty, subject to legal or contractual restrictions and reasonable notice, by: (i) unsubscribing from our Game in your Meta account and ceasing to use the Service; and (ii) contacting us at info@squidostudio.com to inform us that you do not wish us to use your personal information, and that you wish for us to delete all personal information in our possession and control. However, please be advised that if you withdraw or change your consent, we may not be able to provide you with the Service and you may not be able to use certain features or functionality of the Service.
Aside from consent, we may also process your personal information under other legal bases, as permitted by applicable laws.
The security of your personal information is important to us. We protect personal information using physical, technological and organizational safeguards. We regularly review our practices to ensure that they conform to reasonable industry practices appropriate to the level of sensitivity, in order to protect personal information against loss or theft, unauthorized access, alteration or disclosure.
In particular, we have taken security measures generally accepted in the industry to protect personal information submitted to us against loss, misuse, unauthorized access, disclosure, alteration or destruction, and to protect the rights of individuals affected by such personal information, including the following measures:
In the event of a security incident involving us that could result in serious prejudice to you, including unauthorized access, use or disclosure of personal information, loss of personal information or other breach of privacy, we will notify you and, in Quebec (Canada), the "Commission d'accès à l'information", or any similar applicable authority in any other jurisdiction, as soon as possible.
However, no method of transmission over the Internet or method of electronic storage is completely secure; therefore, despite our safeguards and protocols, we cannot fully guarantee the security of your personal information, and you should always exercise caution when disclosing personal information over the Internet.
Applicable privacy laws provide, to varying degrees, individuals with the right to access their personal information in our possession or control, or to request correction of errors or omissions in their personal information. You may request access to and review your personal information in our possession. However, access may be denied where permitted or required by applicable law. If access cannot be granted, we will inform the person who made the request, in writing, within 30 days of the reasons for the refusal.
You may request that we correct your personal information in our possession. We reserve the right not to change any personal information if we do not agree that it is inaccurate or outdated, but we will add any alternative text that the person concerned deems appropriate.
As a general rule, we retain personal information only as long as necessary to fulfill the purposes for which it was collected, or to comply with applicable laws, protect our interests, or for authorized or legitimate reasons. When personal information is no longer necessary or relevant for the identified purposes or is no longer required to be retained under applicable law, we will take steps to delete, destroy, erase, consolidate or make it anonymous. We use reasonable industry practices to ensure that we have adequate controls, schedules and practices for the retention and destruction of information and records that apply to personal information.
As previously mentioned, we use our third-party operator, Modulate, and its ToxMod tool, for its voice chat moderation functionalities. As a result, we share with Modulate certain personal information about you, namely voice recordings of your voice chat sessions, as well as your Meta user ID. These voice recordings are retained for a period of 35 days by Modulate, and then either deleted or anonymized and processed by Modulate in accordance with their privacy policy. We do, however, keep a record of any moderation measures we have had to take in respect of any user. This log will be refreshed after 40 days without a user infraction. Thus, when you activate the microphone and voice chat functionalities, personal information is collected and transmitted to the third-party operators concerned, who handle this personal information in accordance with their own confidentiality and privacy policies. Contact us at info@squidostudio.com for more information about any other third-party policies that may apply.
We do not actively collect email adresses from you. However, when you communicate with us through our Service via your email, this personal information is disclosed to us and will be associated with your user ID. In such cases, we retain your email address, as well as the thread of the conversation between Squido and the user. The purpose of this storage is to ensure the smooth running of our Service and good customer service, as well as to protect our interests.
